What is the procedure required for changing ownership of a jointly held flat?

If I own a DDA (Delhi Development Authority) flat jointly with my mother and need to get the joint ownership transferred to myself and my wife (from the existing joint ownership in my name and that of my mother), what procedure do I need to follow?

  1. u need to get free hold of it done first..go to DDA office meet paatvari of ur area and bribe him to act fast... then u can get flat register in ur n ur wife name geting it as gift form ur mother if u want to save tax or second option get it transfer to ur wife name property tax for women is lower than for males in delhi...good luck
  2. By default you are already 50% owner of the flat. Your mother needs to transfer her 50% share in the flat to your wife. This she can do by excecuting a Release or Relinquish Deed in your wife's favour. Gift Deed is another option. HMT
  3. As per transfer of property act, an instrument registered before registrar is necessary for deriving title. Your wife is not the title holder. Unless your mother transfers her share to your wife, it is not possible to have in the joint name of you and your wife!
